Court overturns dismissals of 1.700 Qantas employees

The Australian airline Qantas is paying dearly for a decision made by its CEO Alan Joyce, who recently stumbled over a consumer protection scandal. The High Court of Australia has declared the dismissal of over 1.700 ground staff null and void. At the beginning of the corona pandemic, the company dismissed many employees and at the same time promised that they would be rehired. In many cases, however, things were different with ground staff, as they then commissioned external service providers. The court declared the procedure null and void. Although Qantas had economic reasons for its approach, it disregarded labor law. Specifically, it also sabotaged the holding of a strike and negotiations with the unions. All of this is now costing Qantas dearly, as it must not only rehire the 1.700 affected employees, but also pay them back wages plus interest.

British Airways: Pilot refusing to wear a mask loses dismissal lawsuit in court

A British Airways pilot who refused to wear a mask during the Corona pandemic lost a legal battle against his former employer in the relevant employment court. The court rejected the arguments, which also pointed to religious issues. The man worked as a first officer for British Airways. During the Corona pandemic, a rift arose because he is said to have strictly refused to comply with the mask requirement at the time. The airline subsequently terminated his employment. The pilot did not want to accept this and took the case to the relevant employment court. During the oral hearing, which was reported by "Mail Online" among others, the co-pilot is said to have said that he was a "sovereign being who has a right to breathe freely". He further argued that his refusal to wear a mask "corresponded to a religious belief and therefore had to be protected". The man also made a comparison between masks and headscarves, which are widespread in Islam, for example. However, the presiding judge was not convinced by the arguments of the dismissed first officer. She rejected the idea that dismissals due to refusal to wear masks would violate the United Kingdom's equality laws. She also found that the co-pilot could impair the right to life of other people by refusing to wear a mask, as they could be more easily infected with Covid-19 without a mask. The actions of the airline British Airways were in line with the scientific findings at the time. Ultimately, the lawsuit was dismissed. In the reasons for the judgment, the judge said, among other things, that the plaintiff "seems to recognize that the exercise of his

Manchester: Ryanair 737 had to land back due to violent passenger

On September 18, 2023, Ryanair flight FR4052 had to return to its place of origin on its way from Manchester to Faro because a passenger on board the aircraft was violent towards a woman. At the time of the incident, the Boeing 737-800 with the registration EI-EBK had already been in the air for around two hours. According to official information, the man suddenly became aggressive towards a woman. When he was verbally reprimanded by a lady who was accompanying him, he apparently completely lost his composure. The unruly PAX is said to have hit his companion hard in the face several times. Other passengers and the crew intervened. A flight attendant immediately informed the captain, who then decided that the flight to Faro would be canceled for safety reasons and that they would return to Manchester. Air traffic control was informed of the incident via radio. Subsequently, there were even reportedly fight-like scenes because the troublemaker would not calm down. This was another reason why police support was requested at Manchester Airport. Shortly after the return landing, the police boarded the medium-haul jet and escorted the unruly PAX away. According to an official statement from the police, they learned of the incident at around 6:25 am local time, or rather, the superior had decided that an operation was necessary. The Greater Manchester Police states, among other things: "When the aircraft returned to Manchester Airport, a man in his 4s was arrested on suspicion of being drunk on board, two counts of assault and a public order offence (Section XNUMXa) and remains in custody at the time of the incident.
