The end of Jet Airways: India's Supreme Court orders liquidation

On November 7, 2024, a final decision was made on the fate of Jet Airways (JAI), once one of India's largest airlines. The country's Supreme Court ordered the liquidation of the airline, bringing an end to a history of failed restart attempts, financial turmoil and legal disputes. This decision marks the end of a company that was considered one of Asia's leading aviation companies years ago, but ultimately collapsed due to mismanagement, financial difficulties and failed rescue plans. Jet Airways was founded in 1993 by Naresh Goyal and quickly grew into one of India's largest airlines. In the 2000s, the company was known for its international connections and high quality of service. However, after a rapid expansion and with increasing competition from low-cost airlines, the airline began to experience financial difficulties in the 2010s. These were exacerbated by rising operating costs, mainly due to high oil prices, and inadequate capital resources. The final crisis came in 2019, when Jet Airways had to cease operations due to liquidity constraints. The aircraft fleet was grounded and thousands of employees lost their jobs. The reasons for the failure were many: high debts, the lack of a clear recovery plan and the pressure to compete with other major Indian and international airlines. As a result, the company filed for insolvency and a long legal battle over the future of Jet Airways began. The Jalan Kalrock Consortium: The last hope? In 2021, a glimmer of hope appeared for Jet Airways when the National Company Law Tribunal (NCLT) declared the Jalan Kalrock Consortium insolvent.

Ryanair warns of consequences of planned increase in air transport tax in the United Kingdom

The British government is planning an increase in the Air Passenger Duty (APD), which is to come into force from April 2026. This announcement has already sparked widespread reactions in the aviation industry, in particular from Ryanair, one of Europe's largest airlines. The Irish low-cost airline has warned in a statement of the possible negative effects: a reduction in flight capacity in the UK of up to 10% in 2025, which could lead to a drop in passenger traffic of around five million passengers. Ryanair, which has already been one of the largest providers of air connections to British airports for years, fears that the increase in the air passenger tax would make the country less attractive for travelers and airlines, with potentially serious consequences for British aviation and the economy. The planned tax increase: an overview On October 30, 2024, British Chancellor Rachel Reeves announced the planned increase in the air passenger tax in her 2024 Autumn Budget speech. This tax, which has been in place since 1994, is set to rise by up to 2 pounds (around $2,50) for short-haul economy class flights. However, private jet flights are particularly affected by the tax increase, with a drastic increase of up to 50% expected. This means that long-haul flights to far-flung destinations such as California could incur additional costs of up to 450 GBP (579 USD) per passenger. The planned tax increases will not only affect air travel in the UK, but could also significantly increase the cost of international flights to and from UK airports. The current air travel tax in the UK varies depending on distance

ECJ rejects Wizz Air's lawsuit against Romanian state aid for Tarom

On 6 November 2024, the European Court of Justice dismissed the action brought by low-cost airline Wizz Air against state aid for Romanian airline Tarom. The Romanian government had approved a loan of around €2020 million in 2 to compensate Tarom for losses due to pandemic-related restrictions. This aid was approved by the European Commission in February 2022. Wizz Air argued that the aid would distort competition as it affected the market in favour of Tarom. However, the ECJ ruled that the aid was compatible with internal market rules as it helped to ensure the connectivity of Romanian regions and avoid social hardship that could arise from the loss of air connections. The decision strengthens the right of Member States to grant state aid in times of crisis to maintain air transport infrastructure and essential air connections. It remains to be seen what impact this will have on future competitiveness and market structure in the European aviation sector.
