Eurowings: Court overturns misleading advertising on CO2 compensation

A landmark ruling has now been made in a legal dispute between Deutsche Umwelthilfe (DUH) and the Lufthansa subsidiary Eurowings. The Cologne Higher Regional Court confirmed the decision of the lower court that Eurowings' advertising on CO2 compensation was misleading and prohibited the company from continuing to advertise with phrases such as "CO2-neutral travel... offset now and take off". This decision not only has consequences for Eurowings, but could also have far-reaching effects on the advertising practices of the entire Lufthansa Group, which has recently been increasingly relying on compensation offers. The central problem that was raised in the proceedings was the wording of the advertising, which gave the impression that the flight's CO2 emissions would be offset before departure. The Higher Regional Court stated that this impression was misleading for many consumers, as they would expect their environmental impact from the flight to be immediately offset. In reality, however, the actual compensation will only take place at a later date - possibly depending on future forecasts and the availability of climate protection projects. The court found that Eurowings had not sufficiently indicated in its advertising that the compensation of CO2 emissions could not take place immediately, but only in the future. Customers should have received more detailed information about the timing and uncertainties surrounding the compensation. This decision sets an important precedent regarding the transparency of advertising promises in the aviation industry. The practice of CO2 compensation at Lufthansa Eurowings is not the only company within the Lufthansa Group that uses CO2 compensation as a marketing strategy. As early as 2023, the Lufthansa Group had introduced the so-called "Green

New cancellation rules from Deutsche Bahn: What travelers need to know

With the timetable change, Deutsche Bahn has introduced changes to the cancellation conditions for flex-price tickets for long-distance travel. These changes have met with mixed reactions from customers. While Deutsche Bahn is emphasizing a clearer structure for its rules, customers are primarily focused on the higher fees and shorter deadlines. From now on, flex-price tickets for long-distance travel can only be canceled or exchanged free of charge up to eight days before the first day of validity. For cancellations made within seven days of the travel date, a fee of ten euros is charged. It is even more expensive for those who decide at short notice: from the first day of validity of the ticket, the cancellation fee is 30 euros. Deutsche Bahn has thus significantly increased the previous cost of 19 euros. For tickets with a return journey, the day of the outward journey is the deadline. This regulation ensures that return journeys that take place later cannot be canceled separately without taking the new fee rates into account. Saver fare tickets remain unchanged. However, the cancellation regulations for the cheaper saver fare tickets remain the same. Travelers can cancel their tickets up to the first day of validity, for which a fee of ten euros is charged. However, the refund is not made in cash, but as a voucher that is valid for three years. The strict rule also remains in place for super saver fare tickets: Cancellation is not possible unless it is made as an immediate cancellation within three hours of booking. Immediate cancellation: A limited time window Deutsche Bahn had already drastically shortened the deadline for the so-called immediate cancellation in the summer of 2024. While customers previously had twelve hours to
