The dispute between Flughafen Wien AG and the politician Helga Krismer (Greens) is entering the next round. In the first instance, an action brought by the airport operator was dismissed. An appeal is to be lodged against this.
The cause of the pending case is that the green politician made public statements in autumn 2022, which the airport management interprets as untrue allegations. On the other hand, they went to court. In the first instance, it was decided that these should be "borderline, but just about justifiable". The lawsuit brought by Flughafen Wien AG was thus dismissed.
But you don't want to let that sit and announce that the appeal will be lodged. The decision of the court of first instance is therefore not yet final and the judgment of the next higher instance must be awaited.
Among other things, Flughafen Wien AG explains: “Anyone who accuses a listed company and its bodies of being involved in “deliberate money laundering” must prove the truth of these allegations. To date, Dr. Krismer cannot provide any kind of proof because these allegations are completely false and therefore there can be no proof".
In a media release, the affected Green politician speaks of a legal success and even describes the lawsuit by Flughafen Wien AG as a "crash landing at the airport". “The attempt to silence an opposition politician in her democratic-political task failed. A stock corporation in which the states of Vienna and Lower Austria hold 40% and the operating facility is on Lower Austrian soil is relevant to my political work. It is my democratic-political mandate to ensure control and transparency. I try to fulfill that, even if the airport wants to see me muzzled," says Krismer. "Günther Ofner obviously bit into me by appealing. I'm not sure whether the airport's appointment is still in the interests of all shareholders or whether it's a personal campaign against me."
