Bad weather is usually considered an exceptional circumstance and releases the airline from paying compensation. But not in this specific constellation, the Berlin Regional Court decided.
The defendant airline canceled the affected connection for the following day "as a precaution" due to a storm forecast. Under the file number 67S49 / 19, the Berlin Regional Court decided that this was not an exceptional circumstance, as there was no corresponding warning from air traffic control. This could have restricted air traffic, but it did not. The court awarded the plaintiff the compensation.
