Precautionary deletion: Airline has to pay

Occasionally it happens that airlines inform their passengers about the decision to cancel the connection the day before when severe weather is forecast. Bad weather is usually considered an extraordinary circumstance and releases the airline from paying compensation. But not in this specific constellation, the Berlin Regional Court decided.

The defendant airline canceled the affected connection for the following day “as a precaution” due to a storm forecast. With file number 67S49/19, the Berlin Regional Court has now ruled that this is not an exceptional circumstance, as there was no corresponding warning from air traffic control. This could have restricted air traffic, but it did not do so. The court awarded the plaintiff compensation.
