Quarantine: Cologne lawyers demand 500 euros in compensation for pain and suffering per day

A law firm from Cologne is demanding damages and compensation for pain and suffering on behalf of clients who had to be quarantined after their return from "risk areas" despite negative PCR results. The lawyers consider the blanket segregation of people who have stayed in "risk areas" to be unlawful.

The basis of the action is the judgment of the Higher Administrative Court in Münster. In November 2020 the Entry regulation of the German state of North Rhine-Westphalia overturned. The judges considered the quarantine to be illegal when returning from “risk areas”. The law firm Rogert & Ulbrich is of the opinion that "several thousand" separation notices are said to have been issued illegally during the pandemic.

The lawyers are of the opinion that the general "home quarantine" after returning from "risk areas" and after possible contact with an infected person could be unlawful, especially if the person concerned was able to show a negative PCR result.

“Sending return travelers to quarantine at home is nonsense, because the trip as such does not lead to a risk, but only to a higher number of contacts with potentially infected people. However, a trip does not necessarily involve a higher number of contacts with infected people and thus a higher risk of becoming infected. This has to be considered individually, but is currently assumed across the board in the Corona ordinances. That is simply wrong and therefore illegal, ”said lawyer Tobis Ulbrich in a media release.

Specifically, compensation for pain and suffering is required in the amount of 100 to 500 euros per day in isolation. The law firm also offers its services and writes in the press release that the claims of all interested parties would be checked. However, what a court will decide in the end remains to be seen.
