The closure of the Lufthansa subsidiary Germanwings now has legal consequences, because numerous flight attendants are complaining about a transfer of operations. A key argument for this is that the pilots should continue to be employed, but the cabin crew was dismissed as of January 31, 2021.

At the sister company SunExpress Deutschland, which was dissolved in the wake of the corona pandemic, former employees are also going to court and want to move in Transfer of operations to the new Lufthansa subsidiary Eurowings Discover is detected. One of the arguments here is that the ACMI services previously provided by SunExpress for Eurowings were virtually "cloned" one-to-one on Eurowings Discover. However, the staff fell by the wayside.

Germanwings officially carried out the last flight in March 2020. AOC and operating license are still active and in order not to endanger the certificates, empty and cargo flights are regularly carried out under the 4U code. This fact now also plays a certain role.

The portal airliners.de quotes lawyer Martin Leufgen, who claims to represent 43 Germanwings flight attendants with the words: “In the current economic situation, why should Eurowings need more pilots if they do not continue to operate Germanwings in a new guise? You have to ask the question ”.

Lufthansa sees the matter completely differently and points out that flight operations have been suspended for almost a year. You are also decaying on a social plan that was concluded with the unions in the autumn. The fact that the pilot has not (yet) been terminated should result solely from the group collective agreement.
